Terms of Service
1. Scope
These Terms govern all purchases on 8kcanvas.com between TEMPEL Design (Max Tempel) ("we", "us") and you as a consumer or business customer. The version in force at the time of your order applies.
2. The service
8kCanvas is a single shared digital canvas with a total resolution of 8K (7680 by 4320 pixels). You can permanently claim pixels and have your chosen display name and, where applicable, your artwork registered on the canvas. A claim is permanent and immutable: once registered, pixels are not overwritten, not resold, and cannot be edited.
3. How a purchase works and pricing
You can claim pixels in two ways:
- Placing pixels directly on the canvas: 1.00 USD per pixel, with no minimum order.
- Creating artwork in the creative builder: 0.10 USD per pixel, with a minimum order of 5.00 USD.
You enter a display name, expressly consent to immediate performance (see the withdrawal page), and pay. Prices are shown as final prices and include any applicable value added tax. We charge in US dollars; your bank or card may convert to your local currency.
4. Conclusion of contract and payment
The contract is concluded when you complete payment through our payment processor by activating the order button labelled "Order with payment". Payment is handled by Stripe. We may refuse or reverse orders in cases of suspected fraud or abuse.
5. Permanence and availability
We register your claim permanently and will not overwrite or resell it. "Forever" refers to the operational lifetime of the service. We do not guarantee uninterrupted or perpetual availability, and we are not liable for unavailability caused by force majeure, technical failure, insolvency, or other events outside our reasonable control. If the service is permanently discontinued, we will use reasonable efforts to publish a final snapshot of the canvas and to make claim data available for export.
6. No resale, no editing
Claims cannot be edited after registration and are not resold by us. The permanence of a claim is an essential characteristic of the product.
7. Names and content
You may use letters including accents, numbers, and single spaces between words, with a minimum of 3 and a maximum of 80 characters. You warrant that your chosen name and any artwork do not infringe third-party rights (including trademarks, copyrights, and personality rights) and do not contain illegal, hateful, sexual, or otherwise prohibited content. You grant us a non-exclusive, worldwide, royalty-free licence to display your name and artwork on the canvas, in the registry, on the certificate, and in related promotion. You indemnify us against third-party claims arising from content you submit, to the extent you are responsible.
8. Moderation and removal
We review names and claims. We may, after confirmation, remove content that violates these Terms or the law. If we remove a claim for a violation, we will refund the amount paid for that claim where technically possible. Approved claims may be moved to an archive that we continue to manage.
9. Charity contribution
For every full 5.00 USD of a purchase, we contribute 1.00 USD to a cause category you select at checkout (for example children and youth, animal welfare, poverty and hunger, disaster relief, health and medical, environment and climate, education and learning). The contribution is made from our own revenue: you pay one price to us, and we, as the donor, pass on the stated share to recognised charitable organisations within your chosen category. We publish a transparent tracker of amounts pledged and donated. You do not become the donor and receive no donation receipt. If you withdraw or your claim is refunded, the full price is refunded.
10. Certificate
After purchase you receive a certificate as confirmation of your contract on a durable medium, available as an immediate download and as a copy by email. The certificate also contains the record of your consent to immediate performance and the withdrawal information.
11. Liability
We are liable without limitation for intent and gross negligence, and for injury to life, body, or health. For slight negligence we are liable only for breach of an essential contractual obligation, limited to the foreseeable, typical damage. Liability under the Product Liability Act remains unaffected.
12. Governing law and consumer protection
German law applies. Mandatory consumer protection provisions of your country of residence remain unaffected. If any provision is invalid, the remainder stays in force.
13. Changes
We may change these Terms for future orders. The version accepted at the time of your order governs that order.
